Job Details
Prosecutes all persons accused through the grand jury process of felony crimes, as well as those who have appealed misdemeanor convictions from district court convictions.
Drafts indictments and presents evidence to the grand jury that will enable its members to decide whether a true bill shall issue. Occasionally presents cases before Grand Juries and juries in other counties based on conflict matters.
Advises, assists and reviews local as well as state law enforcement investigations in the prosecution of criminal matters.
Prepares all forms, pleadings and motions necessary to bring to completion any matter in the statutory jurisdiction of the office.
Follows and executes law enforcement and prosecution policies established by the County Attorney.
Generally on call around the clock and around the calendar to receive reports of RSA 611 deaths. Makes the decision as to whether or not there is to be an autopsy, and directs the course of ongoing investigations. Attends death scenes before they are disturbed to secure them and direct the death investigations. Attends autopsy examinations of RSA 611 deaths.
Represents the State at arraignments and bail hearings in District and Superior Court.
Creates and presents continuing education material to assist law enforcement entities in investigations and charging of Domestic Violence and Sexual Assault cases.
Authorizes intercepts for drug cases in accordance with RSA 573B.
As requested, provides legal advice and guidance on requests from all departments of the county government to the end of avoiding litigation either for or against the county.
Maintains constant contact with the public through court proceedings, discussions with the news media relative to the activities of the County Attorney’s office, and public speaking engagements. Other contacts are typically with the courts, the Sheriff’s department, state and local police departments, correctional facilities, probation and parole offices, hospitals, and other state or county agencies. Contacts occur in person, through use of the telephone and other communications equipment and writing.
Ascertains that legal research is thorough and complete, that reports are completed with accuracy and on time, and ensure that the assigned work program is carried out. Work performed is highly complex professional legal work involving such matters as analysis of difficult legal issues, preparation of pleadings, drafting of indictments and presentation of evidence, conducting investigations and providing legal advice to other government officials. Guidelines for performing work consist of federal, state and local laws and regulations, and legal precedence. Many of the guides lack utility for resolving specific situations, hence, ingenuity and creativity are essential to the position.
Attend and participate in depositions of witnesses and/or experts.
Argue state’s position at sentencing hearings, violation of probation hearings, post-conviction hearings, and motion for new trials.
Serve on committees and/or boards whose main goal is that of improving the quality of justice in Sullivan County.
